Da Krewe du Roux Chicken Run - RELEASE FORM

I, the undersigned (on my own behalf and on behalf of my heirs, personal representatives, successors and assigns), for and in consideration of the opportunity to participate in the Da Krewe du Roux, Chicken Run and related activities (hereinafter “EVENTS”) sponsored and/or conducted by the Da Krewe du Roux, Chicken Run Committee, Tin Cup’s Caddyshack and any companies, organizations, or municipalities participating in the event and their respective officers, directors, employees and agents from (hereinafter, the “RELEASED PARTIES”) released and hold harmless the “RELEASED PARTIES” from any and all claims and demands, rights and causes of action of any kind whatsoever which I now have or later may have against the “RELEASED PARTIES” in any way resulting from, arising out of, or in connection with the performance of their duties and my participation in any said “EVENTS”. This includes use of Tin Cup’s Caddyshack’s tractor (driving and pulling the trailers)

AFFIRMATION OF PARTICIPANT, PARENT, OR LEGAL GUARDIAN:

EIGHTEEN YEARS OR OLDER: I, the undersigned Participant, understand that as a condition for my participation in the Participation Activities, I must sign certain legal documents, including this Participation Agreement, Indemnification, and Liability Waiver. I am signing all such documents, freely, without any fraud or duress, and acknowledge that I have read, understand, and agree to be bound to the same.

UNDER EIGHTEEN YEARS OLD: I, the undersigned, declare that I am the parent or the legal guardian of this minor, and have the legal capacity to execute documents on behalf of such minor. I understand that as a condition for my child to participate in activities, rides or events at the Premises, I must sign certain legal documents, including this Participation Agreement, Indemnification, and Liability Waiver. I am signing all such documents, freely, without any fraud or duress, and acknowledge that I have read, understand, and agree to be bound to the same. **In the event that it is determined that I am not the parent or legal guardian of the minor, or did not have the legal capacity to execute the documents on behalf of said minor, then I agree to defend and indemnify (See Indemnification above for details) the Released Parties if any litigation is instituted, as a result of any injury or death or claim for damage arising out of, relating to, or in any way connected with, minor’s participation in Participation Activities at the Premises**

PHOTO & VIDEO RELEASE: The undersigned agrees to consent to the use of any visual likeness of themselves, whether by film, video, digital or other imagery in which they may appear, and of any accompanying oral material, for promotion and public relations purposes. Signatories additionally agree that any food served during the EVENT may contain bones wheat, egg, dairy, soy, or fish allergens. Please be advised consuming raw, cooked to order or undercooked meat, poultry, seafood, shellfish or eggs may increase your risk of food borne illnesses, especially if you have certain medical conditions.

This Release extends to any and all claims I now have or later may have against the “RELEASED PARTIES'' resulting from or arising out of their performance of their duties whether or not such claims result from negligence (except willful neglect) on the part of any or all of the “RELEASED PARTIES” with respect to the “EVENTS” or with respect to the conditions, qualifications, instructions, rules or procedures under which the “EVENTS” are conducted or from any other cause. I UNDERSTAND THAT THIS MEANS THAT I AGREE NOT TO SUE ANY OR ALL OF THE “RELEASED PARTIES” FOR ANY INJURY RESULTING TO MYSELF OR MY PROPERTY ARISING FROM, OR IN CONNECTION WITH THE PERFORMANCE OF THEIR DUTIES IN SPONSORING, PLANNING OR CONDUCTING THE “EVENTS”.

By signing this RELEASE, I certify that I have read this RELEASE and fully understand it and that I am not relying on any statements or representations made by the “RELEASED PARTIES”.
